The City's Board of Adjustments met January 11th and are to approve the minutes of the December 14th meeting. I have cut out the portion of the minutes (they are very long!) and highlighted in red the portion that pertains to our case. It will be interesting to see the minutes of our case. MINUTES – DECEMBER 14, 2009 MEETING  

Mr. Silverstein noted the findings of fact were just concluded for the December meeting; however, the minutes for the Padgett case were not yet finalized.  Following discussion Mr. McBennett stated the Clerk’s Office will email the minutes to the Board Members once they are complete and then the Board Members will have four days to refer the minutes and offer any corrections.  If there are no corrections then the Board will rule that the minutes will be adopted.

REPORT OF THE BOARD’S ATTORNEY 

Mr. Silverstein indicated the deadline for the filing of briefs in the Hamburg Case appeal noting that the deadline had passed for the filing of brief; however, he was amendable to an extension so that Ms. Hamburg’s attorney could file a brief; however, the briefs should be filed by today. 

Mr. Silverstein indicated an appeal has been filed in the DHIC case by Craig Ralph and the case file will be filed by the City Clerks Office within the next 30 days. 

Mr. Silverstein indicated he has been in discussions with the Padgetts’ attorney and noted a decision has not been made yet as to whether an appeal will be filed.  Mr. McBennett questioned the status of the Hampton Inn case on Glenwood Avenue on Johnson Street with Mr. Silverstein indicating the case has been dismissed without prejudice noting the rezoning application has been approved by the City Council.
